Terms of Service

The use of Anahitapolis products and services is granted to you in accordance with the following terms issued by the rmdStudio Inc. and Peerglobe Technology Inc. who are the legal owners and co-founders of the Anahitapolis™ website and Anahita™ project.

The term "Anahitapolis" refers to the Anahitapolis.com website and its co-founders: rmd Studio Inc. and Peerglobe Technology Inc.

The terms "product" or "software" apply to Anahita Social Networking Engine, any of the Anahita Social Applications, Extensions, and development tools that are distributed via Anahitapolis.

The term "services" applies to published information on how to use the software distributed on Anahitapolis as well as software delivered as service (SAAS) via the Internet.

The term "extension" applies to Anahita Social Applications, Components, Plugins, Modules, and Templates.

What you are purchasing - You are not purchasing an Anahita Software License. Anahita is released under the GPL3 license. You are purchasing a limited time membership in order to access the Anahitapolis resources that are available to the paid members only. These resources include open source software, information on how to use the open source software, and may include software delivered as service via the Internet.

Refund Policy - since Anahitapolis is offering non-tangible goods all sales are considered final and no refunds will be issued once you purchase a membership, which you acknowledge and understand when purchasing a membership on Anahitapolis.

Licenses - All the software that is distributed on Anahitapolis are open source and available under the GPL3, GPL2, MIT, and other types of open source licenses.

Modifications - The GPL license legally allows you to make modifications to the software that you have obtained from the Anahitapolis. It is possible that your modifications make it difficult or impossible to apply future software updates and patches that are provided by Anahitapolis. You acknowledge and agree that in no event Anahitapolis and the core development team are liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of your modified code.

You may however use the copy of the software you obtain from Anahitapolis as many time as you wish for yourself or your clients or provide a copy to one of your friends in order to let them know about Anahitapolis and its services.

Updates - all the extensions that are publicly showcased on Anahitapolis are installable on the latest Birth release of the Anahita™ Social Networking Engine. We can give no guarantee that the extensions will be working with the previous releases of Anahita™ Social Networking Engine. Members may communicate the issues with us on the Anahitapolis support groups and projects.

Delivery - once we receive your payment, your Anahitapolis account credentials as well as an invoice are emailed to you either immediately or within the first hour. Once you sign in to the Anahitapolis.com, as a paid member, you are granted access to all the available Anahitapolis resources described in the membership package that you have purchased. After you membership expires, the resources become unavailable to you until you purchase one of the offered membership packages again. After your membership expires, you may continue using the software you have obtained from Anahitapolis during your previous membership period.

Assignability - Anahitapolis memberships are none-transferable and cannot be shared or resold.

Warranty - All the software that is distributed and all the information that is made available on Anahitapolis are provided "As Is" without any warranty of any kind, either expressed or implied. In no event Anahitapolis and the core development team are liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages or other losses arising out of the use of or inability to use the Anahitapolis products and services.

Use of Content - The Anahitapolis website content is licensed under a Creative Commons Attribution-NonCommercial-NoDerivs 3.0 Unported License. Based on a work at www.anahitapolis.com. Permissions beyond the scope of this license may be available on Anahitapolis website.

Privacy - Anahitapolis reserves the right to make any of the information that you have posted on the Anahitapolis groups, projects, or personal profiles publicly available. Administrators can see all of your private data even if you set the privacy to "myself only". Do not post any content that you'd feel uncomfortable for the admins to see. Even though there is a privacy management in place, do not post any content or information that you wouldn't normally make publicly available on the Internet. We do not guarantee to guard and maintain your profile's privacy for you.

Support - Anahitapolis offers software, services, and information "as is", with no implied meaning that they will function exactly as you wish or with all 3rd party technologies. Further, we offer no support via email or otherwise for installation, customization, administration, etc. as a part of Anahitapolis membership plans. Anahitapolis provides private support areas such as groups, projects, etc. available to the paid members only. Anahitapolis does not commit to oversee these areas, but we reserve the right to whether or not respond and answer questions. You acknowledge by your use of Anahitapolis products, services, and information that it is at your sole risk, and that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with the software, services, and information provided by Anahitapolis.

You agree to indemnify and hold Anahitapolis harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the software, information, or services provided by the Anahitapolis.

Anahitapolis reserves the right to change the Terms of Service from time to time. Anahitapolis reserves the right to modify or discontinue any portion of the membership. Anahitapolis shall not be liable to your or any third party should Anahitapolis exercise its right to modify, suspend, limit or discontinue any features of the membership.

This agreement and the use of Anahitapolis products and services are governed by the laws of the Vancouver, British Columbia, Canada. If any provision of the Terms of Service are held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.
